Terms and Conditions

The following terms and conditions are in place to ensure we maintain a safe and fair working relationship between CTLNZ Excavation and our customers.

These terms and conditions have the following expressions and meanings:

WE and US and OUR refers to CTLNZ Excavation which will be also now be referred to as CTLNZ.
YOU and YOUR will refer to you as the  customer of CTLNZ Excavation.
Services – meaning any services and materials supplied by CTLNZ Excavation.

Estimates, Variations & Unforeseen Work

Any estimate or quotation provided is based solely on the information supplied by the Client and on site conditions reasonably apparent at the time of pricing. Unless expressly stated otherwise, all pricing is an estimate only and does not constitute a fixed price contract.

The Client acknowledges that once works commence, latent conditions, unforeseen circumstances, inaccuracies in supplied information, or changes in scope may arise. The Contractor reserves the right to adjust pricing to reflect the actual work required, including additional labour, materials, plant, subcontractors, compliance costs, or time.

Where practicable, the Contractor will notify the Client of significant variations; however, the Contractor is not required to obtain prior approval where urgent work is necessary to complete the project safely, comply with legal obligations, or prevent damage, delay, or further cost.

The final invoice will reflect the actual work completed and costs incurred. The Client agrees to pay all reasonable additional costs arising from variations or unforeseen circumstances, notwithstanding any difference from the original estimate.

All prices are in New Zealand dollars and include 15% Goods and Services Tax (GST).

Payment Terms
Payment terms are strictly pay on invoice unless prior arrangment has been made with management.

Customers will be invoiced after completion or services. CTLNZ reserve the right to remove any materials supplied if payment is not made within agreed terms.

CTLNZ shal be entitled at its descretion to charge the buyer interest on any outstanding moneys at the rate of 1.5% at the commencement of each 30 day period.   Any moneys outstanding shall accrue interest on a monthly basis.

The buyer shall also be liable to pay all resonable costs charges and legal expenses of CTLNZ in relation to obtaining or seeking to obtain remedy of collection of outstanding accounts.

Privacy Act 1993
If you are an individual, you have rights under the Privacy Act 1993 to access information held by us, and to request thecorrection of such personal information.

Changes to Terms and Conditions
These terms and conditions may be changed from time to time. All changes will be effective immediately upon posting changes on the website.

It is the responsibility of all CTLNZ customers to be familiar with the latest terms and conditions.
